Is DirecTV's Attempts to Lease HR10-250 Legal?

Will 6 June 2006 01:55:34
DirecTV is now making the claim that an HR10-250 that you pay less than the
full list price for ($749) must be a leased unit. They are extremely
aggressive about this, and it took two transfers and a supervisor to get
this changed. The first level of activation has no power to negotiate at
all, and they simply strong-arm you and say that the unit must be leased and
you have no choice. When you hold your ground and insist that you bought
the item and want to own it, they transfer you to a special group they claim
can handle that request. That second group then asks you what you paid,
and if your answer is anything less than the full list price, they also
insist that you are leasing the unit and have not purchased it, and they
demand not only a lease, but that you agree to two additional years of
service on top of this.

Only after demanding to speak to a supervisor and explaining that you bought
the unit at retail and not from DirecTV did they cave in and agree to show
the unit as purchased, without an additional two year commitment.

Is this kind of hardball sales pitch even legal? They are trying to
modify the terms of sale on an invoice for one of their retail purchased
units. No one is going to tell me that this behavior isn't deliberate,
and it is clearly done with lots of planning and participation of management
to build entire business processes to support it. I can't believe that
this behavior doesn't violate some kind of consumer protection laws in
various states. Probably 90% of the consumers who call just cave in and
do whatever DirecTV tells them to do.
